KKG obtained summary judgment for a commercial landlord in a hotly contested case involving the tenant's attempted early termination of a lease. The landlord asserted that the tenant failed to follow the requirements of the lease’s early termination provision. The trial court agreed with KKG's arguments on behalf of the landlord and ruled that the tenant remained liable for rent throughout the final two years of the lease term. The tenant appealed, and the case settled pending appeal. The landlord received full payment of all of its rent, its attorneys’ fees, and payment of partial interest.
